I am regularly appointed as Realtor of Record in divorce cases through the Genesee County Family Court. It has been both an educational and professionally rewarding experience. Over time, I have learned that the sale of a marital home during a divorce is fundamentally different from a traditional transaction. Each case carries unique legal, financial, and emotional considerations, and the details required to ensure a successful closing for both parties demand a higher level of precision and care.
Recognizing that complexity of the cases, I sought formal training specific to divorce-related real estate transactions. After extensive study, I completed a comprehensive program and became a Certified Divorce Realtor. Today, I am one of a limited number of agents nationwide who have earned this designation.
The competencies required in these cases extend well beyond standard marketing and negotiation skills. They involve neutrality, structured communication, and disciplined process management in environments where conflict is often present.
- When representing the sale of a home due to divorce, I am expected to bring market expertise supported by a data driven pricing and sales strategy.
- I am responsible for identifying and resolving transactional obstacles before they jeopardize closing.
- I must actively prevent, manage, and deescalate conflict as it relates to the property.
- I serve as a neutral fiduciary to both parties, with no bias or vested interest in either spouse’s outcome.
- Above all, I am charged with ensuring that the property sells efficiently and in accordance with court orders and settlement agreements.
There are also strict boundaries. I cannot show favoritism or create any appearance of impropriety. I do not operate as a dual agent in a manner that compromises neutrality. I never place my interests above those of my clients. And I do not provide legal, tax, or family law advice. In divorce transactions, clarity around roles and limitations is essential.
Experience has taught me practical safeguards as well. For example, I avoid meeting with both spouses at the property simultaneously when tension is high. Subtle dynamics can influence decision making in ways that are not immediately visible. Maintaining separate, but equal communication channels leads to better outcomes and clearer alignment with each party’s stated goals.
As a fiduciary to both parties, I am required to remain impartial while keeping each spouse fully informed throughout the transaction. I also maintain strict confidentiality. In some cases, I have testified as an expert witness during hearings or have been called upon by the court to clarify valuation or market conditions. That level of scrutiny requires careful documentation and disciplined adherence to professional standards.
Divorce real estate is not simply about listing and selling a home. It is about structure, neutrality, and risk management during a legally sensitive process. A well intentioned but untrained agent can unintentionally escalate conflict or create complications that delay the divorce.
If you, a family member, or a friend ever face the need to sell a home during a divorce, it is worth speaking with someone who understands the legal environment, the emotional dynamics, and the procedural requirements involved. My goal in these cases is straightforward: create clarity, maintain fairness, and move the transaction to a successful close with as little additional strain as possible.
